Please read these Terms of Service carefully before using the Azores Guest Guide platform. By creating an account or using our services, you agree to be bound by these terms.

1. Parties and Identification
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Owner", "User") and the operator of the Azores Guest Guide platform ("Platform", "we", "us").
Platform operator: RAFM Investimentos, Lda., a company incorporated under Portuguese law, with registered address at Rua Isabel Gusmão, Nº 4, Livramento, 9500-778 Ponta Delgada, Azores, Portugal, with NIF (Tax Identification Number) 517992892.

2. Service Description
Azores Guest Guide is a software-as-a-service (SaaS) platform that enables short-term rental property owners and managers to create, manage, and share digital guest guides for their properties.
The Platform provides tools including: property management dashboards, digital guest guide creation, secure guest-access link generation, local recommendations management, compliance template tools, and related features.
The Platform is a tool to assist property owners. It does not provide legal advice, property management services, or guarantee any specific outcome for your rental business.
3. Acceptance of Terms
By registering an account, clicking "Create Owner Account", or otherwise accessing the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you are registering on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
You must be at least 18 years of age to use the Platform. By accepting these Terms, you confirm that you meet this requirement.
We reserve the right to update these Terms at any time. Continued use of the Platform after a modification constitutes acceptance of the revised Terms.
4. Account Registration and Security
You must provide accurate, current, and complete information during registration and keep your account information up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must notify us immediately at hello@azoresguestguide.com of any unauthorized use of your account or any other breach of security.
We are not liable for any loss or damage arising from your failure to maintain the security of your account.
You may not share your account with others or create multiple accounts for the same person.
5. Acceptable Use and Prohibited Conduct
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You shall not:
• Upload, transmit, or distribute any content that is defamatory, obscene, fraudulent, illegal, or that violates the rights of any third party;
• Misrepresent your identity, your properties, or the information you publish in guest guides;
• Use the Platform to facilitate any illegal activity, including but not limited to short-term rental activity without the required Alojamento Local (AL) licence;
• Attempt to gain unauthorized access to any part of the Platform, its related systems, or data belonging to other users;
• Introduce viruses, malware, or any other harmful code;
• Use automated means (bots, scrapers) to access the Platform without our prior written consent;
• Reverse-engineer, decompile, or disassemble any part of the Platform.
We reserve the right to investigate violations and suspend or terminate accounts found to be in breach of these provisions.
6. Subscription Plans and Payment
Access to certain features of the Platform requires a paid subscription. The available plans, features, and pricing are described at the time of purchase and may be updated with 30 days' advance notice.
Subscriptions are billed on a recurring basis (monthly or annual) as chosen at the time of sign-up. Payment is due at the start of each billing cycle.
All prices are stated in Euros (EUR) and are exclusive of applicable taxes (including IVA/VAT) unless otherwise stated. You are responsible for any applicable taxes in your jurisdiction.
Payment processing is handled by our third-party payment processor. We do not store your full payment card details.
If a payment fails, we may suspend access to paid features until payment is successfully processed. We will notify you by email before suspension.
We reserve the right to change our pricing with 30 days' written notice sent to the email address associated with your account. Continued use of the Platform after the price change constitutes acceptance.
7. Cancellation, Refunds, and Withdrawal Right
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until then.
14-Day Withdrawal Right: In accordance with EU Directive 2011/83/EU and Portuguese Decree-Law 24/2014, if you are a consumer and have subscribed to a paid plan, you have the right to withdraw from the contract within 14 days of the subscription start date without giving any reason, provided that you have not yet made use of the digital service. By expressly requesting immediate access to the Platform upon subscription, you acknowledge that this right to withdrawal may be forfeited once the service has begun. Where applicable, a proportional refund may be granted.
For billing disputes, please contact us at hello@azoresguestguide.com within 30 days of the disputed charge.
We do not offer refunds for partial billing periods, except where required by applicable law.
Free tier accounts (if applicable) may be cancelled at any time with no financial obligations.
8. Intellectual Property
The Platform, including its design, code, trademarks, logos, and content created by us, is owned by the Platform operator and is protected by intellectual property laws.
You retain ownership of all content you upload or create through the Platform, including property descriptions, images, and custom guides ("Your Content"). By uploading Your Content, you grant us a non-exclusive, worldwide, royalty-free licence to host, display, and process Your Content solely to provide the Platform services.
You represent and warrant that you have all necessary rights to Your Content and that it does not infringe the intellectual property rights of any third party.
You may not copy, modify, distribute, or create derivative works of any part of the Platform without our prior written consent.
Upon account termination, the licence granted above terminates. We will make Your Content available for export for 30 days following termination.
9. Personal Data and GDPR (RGPD)
We are committed to protecting your personal data in accordance with EU Regulation 2016/679 (General Data Protection Regulation / Regulamento Geral sobre a Proteção de Dados) and Portuguese law.
Data Controller: The Platform operator identified in Section 1 is the data controller for personal data you provide when registering and using the Platform as an owner.
Data Collected: We collect your name, email address, phone number (optional), property information, and usage data for the purpose of providing and improving the Platform.
Legal Bases for Processing (Art. 6 GDPR):
• Contract performance (Art. 6(1)(b)): processing your account data to provide the services you requested;
• Legitimate interests (Art. 6(1)(f)): platform security, fraud prevention, and aggregate analytics;
• Legal obligation (Art. 6(1)(c)): where required by Portuguese or EU law.
Your Rights as a Data Subject (Arts. 15–22 GDPR): You have the right to access, rectify, erase, restrict processing of, and obtain portability of your personal data. You also have the right to object to processing based on legitimate interests. To exercise these rights, contact us at hello@azoresguestguide.com.
Supervisory Authority: You have the right to lodge a complaint with the CNPD (Comissão Nacional de Proteção de Dados), the Portuguese data protection supervisory authority, at www.cnpd.pt.
Data Retention: We retain your account data for as long as your account is active and for up to 3 years after account closure, unless a longer retention period is required by law.
Our full Privacy Policy provides additional detail on data processing practices and is incorporated into these Terms by reference.
10. Owner Responsibilities for Guest Data
When you use the Platform to share digital guides with your guests, you may collect or process personal data about those guests (such as access log data).
For the purpose of applicable data protection law, you are an independent data controller with respect to your guests' personal data. You are solely responsible for ensuring that your collection and use of guest data complies with the GDPR, Portuguese law, and any other applicable regulations.
The Platform acts as a data processor on your behalf only to the extent necessary to provide the guest access functionality. By using these features, you agree to our Data Processing Addendum, which is incorporated into these Terms.
You must have a lawful basis for any processing of guest personal data and must provide appropriate privacy notices to your guests.
11. Limitation of Liability
To the maximum extent permitted by applicable law, the Platform and its operators shall not be liable for:
• Any indirect, incidental, consequential, special, or exemplary damages arising from your use of the Platform;
• Loss of revenue, profits, data, or business opportunities;
• Disputes between you and your guests, or any claims arising from your rental activity;
• The accuracy or completeness of information provided in the Platform's local guide or compliance template features;
• Failures of third-party services (including Google Maps, weather data providers, or email delivery services).
Our total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the total amount paid by you to us in the 12 months preceding the claim.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under Portuguese or EU law.
12. Alojamento Local Compliance Disclaimer
The Platform includes tools and templates to assist property owners with Alojamento Local (AL) regulatory requirements in the Azores and Portugal, including content related to guest registration and house rules.
These tools are provided for informational and operational convenience only. They do not constitute legal advice and do not guarantee compliance with applicable law.
As an AL property operator, you remain solely responsible for:
• Registering your property in the RNAL (Registo Nacional dos Alojamentos Locais);
• Complying with guest identification and reporting obligations under the Serviço de Estrangeiros e Fronteiras (SEF)/AIMA;
• Meeting all local council (câmara municipal) and regional government requirements;
• Paying all applicable local accommodation taxes (taxa municipal turística);
• Any other legal obligations applicable to short-term rental activity in your jurisdiction.
We recommend consulting a qualified legal professional for advice specific to your situation.
13. Third-Party Services
The Platform integrates with third-party services including Google Maps, OpenWeatherMap, and Resend (email delivery). Your use of these services through the Platform is also subject to their respective terms of service and privacy policies.
We are not responsible for the availability, accuracy, or content of third-party services. We will endeavour to notify you of significant changes to our third-party service integrations.
Links to external websites or resources within the Platform are provided for convenience. We do not endorse and are not responsible for the content of those external sites.
14. Service Availability
We aim to provide a reliable service but do not guarantee uninterrupted or error-free access to the Platform. The Platform is provided on an "as is" and "as available" basis.
We may perform scheduled or emergency maintenance that temporarily interrupts the service. We will endeavour to provide advance notice of scheduled maintenance where practicable.
We are not liable for any loss or inconvenience caused by temporary unavailability of the Platform.
15. Modifications to Terms
We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days' advance notice by email to the address associated with your account and/or by a prominent notice within the Platform.
If you do not agree with the modified Terms, you may cancel your account before the changes take effect. Continued use of the Platform after the effective date of modifications constitutes acceptance.
The "Last updated" date at the top of this page reflects the most recent revision.
16. Termination
You may terminate your account at any time by contacting us at hello@azoresguestguide.com or through your account settings.
We may suspend or terminate your account immediately if: (a) you breach these Terms; (b) we are required to do so by law; (c) we reasonably believe your use poses a security or legal risk to the Platform or other users.
Upon termination, your right to access the Platform ceases. We will retain a copy of your data for up to 30 days following termination during which you may request an export. After that period, your data will be deleted in accordance with our data retention policy.
Sections 8, 9, 11, 17, and 18 of these Terms survive termination.
17. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Portuguese Republic, without regard to its conflict of law principles.
Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ponta Delgada, Azores, Portugal, except where mandatory consumer protection law in your country of residence provides otherwise.
For disputes involving consumers, the European Online Dispute Resolution platform (ec.europa.eu/consumers/odr) may be used.
